The State Administration for Market Regulation Plans to Amend the E-commerce Law

  In order to strengthen the protection of intellectual property rights, standardize the economic order of the platform, and promote the sustainable and healthy development of e-commerce, the State Administration for Market Regulation drafted the “Decision on Amending the E-Commerce Law of the People's Republic of China (Draft for Comment)” to solicit public opinions.

  The amendments mainly focus on Article 43 and Article 84.Extending the waiting period after counter-notificationwill be adopted to strengthen the protection of intellectual property rights and standardize the economic order of the platform.That is, “If the e-commerce platform operator does not receive a notice of complaint or lawsuit within 15 days after the transfer statement reaches the intellectual property right holder, it shall promptly terminate the measures taken.” is amended toIf the e-commerce platform operator does not receive a notice of complaint or lawsuit within 20 working days after the transfer statement reaches the intellectual property right holder, it shall promptly terminate the measures taken.
