The Supreme People's Court and the Ministry of Justice Jointly Issue the Guidelines on Fully Leveraging the Function of Arbitration to Serve the High-quality Development of the Guangdong-Hong Kong-Macao Greater Bay Area
In order to implement the decisions and arrangements of the CPC Central Committee on promoting the construction of the Guangdong-Hong Kong-Macao Greater Bay Area (GBA), give full play to the functions and advantages of the arbitration system, establish a market-oriented, law-based and international world-class business environment, and promote the high-quality development of the GBA, the Supreme People's Court (SPC) and the Ministry of Justice (MOJ) recently jointly issued the Guidelines on Fully Leveraging the Function of Arbitration to Serve the High-quality Development of the Guangdong-Hong Kong-Macao Greater Bay Area (Guidelines).
The Guidelines specifies the "Hong Kong (Macao)-funded Hong Kong (Macao) arbitration" system, proposing that Hong Kong-funded and Macao-funded enterprises established in the nine mainland cities of the GBA may agree that the mainland is the seat of arbitration, and that Hong Kong and Macao may be the seat of arbitration to resolve commercial disputes.
The Guidelines makes detailed implementation of the planning and construction of the GBA International Commercial Arbitration Center, and sets forth requirements for the expansion of service areas for arbitration institutions in the nine mainland cities of the Greater Bay Area, the improvement of the arbitration and litigation mechanism and the judicial support and supervision mechanism, the sharing of resources between arbitrators and arbitration secretaries in Guangdong, Hong Kong and Macao, the establishment of an information sharing mechanism between the people's courts, judicial administrative organs and arbitration institutions, and the establishment of a working mechanism for the joint training of foreign-related arbitration talents.
