China passes new law against telecom and online fraud

China’s top legislative body on 2 September 2022 approved the Law of People’s Republic of China on Combating Telecom and Online Fraud at the 36th meeting of the 13th Standing Committee of the National People's Congress. 

The legislation, based on the people-centered approach, provides strong legal support for fighting telecom and online fraud.

The newly passed law, with 50 articles in seven chapters, contains general provisions, telecommunications governance, financial governance, internet governance, comprehensive measures, legal liabilities, supplemental provisions. It will take effect on 1 December 2022.

The legislation aims at the establishment of a preventive legal system and the forming of an industry-wide and whole-of-society system for preventing and combating telecom and online fraud. Combined with the anti-telecom and online fraud practice, the law stipulates that departments, businesses and local governments should act in concert with each other and facilitate fast cross-sectoral and cross-regional coordination and cooperation so as to effectively curb such law-breaking activities.
